ANVR Consumer terms and conditions

Travel booked with Avila Reizen B.V. (KvK no 51111616) is subject to the ANVR Consumer Terms and Conditions and the supplementary Avila Reizen B.V. Travel Terms and Conditions, as of 1 July 2018. The ANVR maintains strict membership standards and promotes the quality of travel and information about it. The trips on this website are offered under the ANVR Travel Conditions (Travel and/or Booking Conditions and/or Linked Travel Package Conditions) which apply to all offers on this website unless expressly stated otherwise.

Additional Avila Travel terms and conditions

These following conditions have been drawn up by ourselves, Avila Reizen B.V., and apply in addition to the ANVR Travel Conditions as they read as of 1 July 2018. No consultation has taken place between ANVR and Consumers' Association within the framework of the Self-Regulation Coordination Group of the Social and Economic Council regarding the content of these articles. Except for the deviations permitted in the terms and conditions themselves, these own provisions cannot detract from the ANVR Travel Terms and Conditions and are only intended to supplement the ANVR terms and conditions where stated in the ANVR terms and conditions themselves and/or to further strengthen the traveller's position.

Article 1. General provision
Where the ANVR consumer conditions refer to the tour operator, Avila Reizen is meant.

Article 2. Payment and payment
2.1. On conclusion of the contract, a down payment of 30% of the total travel sum agreed for the country package is due (with a minimum of € 150 per person) plus any payments for insurance premiums and costs included in the travel contract. If airline tickets are also part of the travel package organised by Avila Reizen, they must be paid in full immediately at the conclusion of the contract. In exceptional cases (e.g. cruises or special excursions) different (down)payment arrangements may apply. For group travel and incentives, different down-payment rules apply.
2.2. The balance of the travel sum must be paid no later than eight weeks before the day of departure. If payment is not made in time, the traveller will be in default. This may result in cancellation, in which case the traveller will be charged the cancellation fee.
2.3. If the contract is concluded within eight weeks before the day of departure, the entire travel sum must be paid immediately.
2.4. The traveller who fails to pay on time shall owe statutory interest on the amount still due. In addition, extrajudicial collection costs (15% of the amount claimed) shall be charged.
2.5. Payments should preferably be transferred to the account of Avila Reizen or, if desired, paid in cash. Payment by credit card is also possible, we charge a surcharge of 2.9% for payments by credit card.
2.6. Avila Reizen charges an administration fee of € 50 per agreement.

Article 3. Termination by the traveller (cancellation)
3.1 If the contract is cancelled by the traveller, the travel organiser will charge the traveller the following cancellation costs in addition to any reservation costs owed:
* for cancellation up to the 42nd calendar day (exclusive) before the day of departure: the deposit;
* If cancelled from the 42nd calendar day (excluding) to the 28th calendar day (excluding) before the day of departure: 35% of the travel sum;
* Cancellation from the 28th calendar day (exclusive) to the 21st calendar day (exclusive) before the departure day: 40% of the travel sum;
* If you cancel from the 21st calendar day (exclusive) to the 14th calendar day (exclusive) before the day of departure: 50% of the travel sum;
* cancellation from the 14th calendar day (exclusive) to the 7th calendar day (exclusive) before the day of departure: 75% of the travel sum;
* Cancellation from the 7th calendar day (exclusive) to the day of departure: 90% of the travel sum;
* for cancellation on the departure day or later: the full travel sum.
3.2. If a trip is composed of several components to which different cancellation provisions apply, the supplier's provisions specifically applicable to each component apply. For example, a different cancellation arrangement may apply to cruises, car hire, special excursions, special services such as national parks and cultural or sports events. At the latest when booking, it will be indicated whether, contrary to the above-mentioned cancellation fee scale, specific cancellation provisions apply to parts of the trip.
3.3 For international and domestic airline tickets, cancellation costs of 100% of the travel sum apply from the time of booking. If you specifically wish to book airline tickets that can still be changed or cancelled, you must make this known in advance.
3.4 Cancellation by traveller from a travel group
3.4.1 If a traveller from a travel group cancels their share of a travel contract for a joint stay in a hotel, flat, holiday home or other accommodation, they shall be liable to pay a cancellation fee.
3.4.2 If the size of the remaining party appears in the price table for this accommodation, the tour operator will make the remaining traveller(s) an offer of modification appropriate to the new group size for the same period and in the same accommodation.
3.4.2 The fare for the traveller(s) referred to above will be changed in accordance with the price table. Payment of the amended travel sum will be subject to the normal payment rules applied by a tour operator.
3.4.3 If the amendment offer is not possible or is not accepted, the contract will be cancelled for all travellers and all travellers will be liable for cancellation charges.
3.4.4 The total amount of cancellation charges and amended travel sums will not exceed the total travel sum of the original travellers. Any excess will be deducted from the new travel sum.
3.5. Cancellations outside office hours are deemed to be made on the next working day.

Article 4. Complaints procedure
4.1. An observed shortcoming in the performance of the agreement must be reported to the service provider concerned as soon as possible, so that it can find a suitable solution. If the shortcoming is not resolved and detracts from the quality of the trip, it must be reported immediately to the local representation or, if unreachable, to Avila Reizen. Communication costs will be reimbursed by Avila Reizen, unless it appears that they reasonably should not have been incurred. Proof of incurred costs (invoices) must be shown. If afterwards it appears that the traveller did not comply with this reporting obligation and Avila Reizen was not given the opportunity to remedy the shortcoming, his possible right to compensation may be limited or excluded.
4.2. If a complaint is not satisfactorily resolved, it must be submitted to Avila Reizen in writing and with reasons no later than one month after the end of the trip. If the complaint does not concern the execution but the formation of a contract, it must be submitted to Avila Reizen within one month after the traveller learns of the facts to which the complaint relates.
4.3. Dutch law applies to all disputes between Avila Reizen and the traveller.

Article 5. Travel documents and travel documents
The traveller must be in possession of the necessary valid documents at departure and during the trip, such as a passport and any required visas, proof of vaccinations/vaccinations and (international) driving licence (in case of self-drive). The traveller must check the general information provided by Avila Reizen for accuracy at authorities that can give definite information about this. If the aforementioned is not complied with by the traveller and the traveller cannot or cannot fully make the trip, the costs and all related consequences are for the account of the traveller.
5.2. During the travel arrangement, the traveller must be in possession of insurance covering at least the risk of hospital, medical, funeral and repatriation costs in a reasonable manner.
5.3. Avila Reizen puts the necessary travel documents in the possession of the traveller no later than 10 days before the day of departure, provided full payment for the trip has been made.

Article 6. Modification by the traveller
Up to 28 days before departure, the traveller can request changes to the agreement. These changes will be made to the extent possible. In case of an altered travel sum, the traveller must pay the altered travel sum, minus monies already paid. In addition to the actual costs, the amendment costs amount to € 25 per booking per amendment and any communication costs. Postponement of the departure date or reduction of the number of paying passengers is considered a (partial) cancellation to which Article 2 applies.

Article 7. Changes by Avila Reizen
The traveller who exercises his/her right to reject the change or alternative offer pursuant to the previous paragraphs must make this known within 3 working days of receiving notification of the change. From 10 days before departure, a period of 24 hours (1 working day) applies for this. In that case, Avila Reizen has the right to terminate the contract with immediate effect. It must (on pain of expiry) make use of this right within 3 working days after receipt of the notification of the change by the traveller. From 10 days before departure, a period of 24 hours (1 working day) applies. In such a case, the traveller is entitled to cancellation or restitution of the travel sum (or, if part of the trip has already been enjoyed, to restitution of a proportionate part thereof) within 2 weeks.

Travel Guarantee Fund Foundation (SGR)

Avila Reizen B.V. (KvK no 51111616) is a member of SGR. You can check this at www.sgr.nl. Within the limits of the SGR guarantee scheme(www.sgr.nl/garantieregeling) the trips published on this website are covered by the SGR guarantee. This SGR guarantee means that the consumer is assured that his pre-paid travel money will be refunded if the other party cannot fulfil the agreed performance due to financial insolvency. Insofar as the agreement includes transport and the destination has already been reached, the return journey will be taken care of.

Own contribution to SGR
Since 1 February 2021, for every trip booked with an SGR member travel organisation, a contribution of €5 per person per booking is levied. This allows you to continue to travel carefree.

Avila Reizen B.V. (KvK no 51111616) is affiliated to the Stichting Calamiteitenfonds Reizen. The guarantee of the Calamiteitenfonds means that you, as a traveller taking part in a trip to which the guarantee applies:
- (part of) your travel sum will be refunded if we are unable to complete or complete the trip due to a calamity;
- be reimbursed for the necessary additional costs if we have to make changes to the trip or have to repatriate you early due to a disaster.

Calamity means an abnormal event caused by molest or natural disaster. More information about the Calamity Fund can be found at www.calamiteitenfonds.nl.
